2. Description of Services

Sierra Vista Asphalt Paving is a state-licensed and fully insured asphalt paving contractor serving Sierra Vista, AZ and surrounding communities. Our services include, but are not limited to, asphalt paving, sealcoating, crack sealing, pothole repair, driveway paving, parking lot paving, asphalt resurfacing, milling, grading and excavation, concrete curbing and sidewalks, drainage solutions, speed bump installation, and related pavement maintenance services.

All services are provided subject to site conditions, material availability, and weather. We reserve the right to decline a project at our discretion.

3. Estimates and Pricing

All estimates provided by Sierra Vista Asphalt Paving are based on the information available at the time of assessment and are subject to change if site conditions differ from what was observed or described. A written estimate will be provided before work begins. The estimate constitutes our best assessment of the scope and cost of the project, but it is not a fixed-price guarantee unless explicitly stated as such in a written contract.

Any changes to the scope of work after an estimate has been accepted - including unforeseen site conditions, additional materials, or customer-requested modifications - may result in additional charges. We will notify you of any material changes before proceeding where reasonably practicable.

4. Scheduling and Cancellation

Scheduled job dates are subject to weather conditions, equipment availability, and other factors outside our control. We will notify you as soon as reasonably possible if a scheduled job needs to be rescheduled.

If you need to cancel or reschedule a confirmed job, please contact us as early as possible. Cancellations made with less than 48 hours notice for scheduled work may result in a cancellation fee to cover mobilization costs already incurred. Any deposits paid toward materials or equipment staging may be non-refundable depending on the circumstances.

5. Payment Terms

Payment terms will be specified in the written estimate or contract for each project. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, we may require a deposit before work begins, with the remaining balance due upon completion.

Accepted payment methods will be communicated at the time of estimate. Invoices not paid within the agreed timeframe may be subject to late fees. We reserve the right to pursue collection for unpaid invoices, including recovery of reasonable collection costs and attorney fees where permitted by law.

6. Warranty Disclaimers

Sierra Vista Asphalt Paving stands behind the quality of our workmanship. Any specific warranty terms will be stated in the written contract for your project. Unless otherwise specified in writing, we do not offer implied warranties beyond what is required by applicable Arizona law.

Asphalt and pavement materials are subject to normal wear and performance variations related to climate, traffic, soil conditions, and maintenance. Our workmanship warranty does not cover damage caused by factors outside our control, including but not limited to: extreme weather events, ground movement, tree root intrusion, heavy vehicle loads beyond those disclosed at the time of estimate, or failure to perform recommended maintenance such as periodic sealcoating and crack filling.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Sierra Vista Asphalt Paving shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or from our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to our services shall not exceed the amount you paid us for the specific service giving rise to the claim.

8. Dispute Resolution

If a dispute arises between you and Sierra Vista Asphalt Paving regarding services rendered or these Terms, we encourage you to contact us directly first so we can attempt to resolve the matter informally. Most issues can be resolved through direct communication.

If we are unable to resolve a dispute informally, both parties agree to attempt mediation in good faith before pursuing litigation. Nothing in this section prevents either party from seeking emergency injunctive relief from a court when necessary to protect rights or prevent irreparable harm.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding relating to these terms or our services shall be brought exclusively in the state or federal courts located in AZ, and you consent to the jurisdiction of those courts.
